The European Data Protection Supervisor (EDPS) has adopted Opinion 7/2026 on the European Commission’s proposal to extend the application of Regulation (EU) 2021/1232, commonly referred to as the Interim Regulation.

The Commission’s proposal, issued on 19 December 2025, seeks to prolong the temporary framework that permits providers of certain online communication services to detect, report and remove child sexual abuse material. The Interim Regulation was introduced as a temporary measure pending agreement on a broader, long-term legislative framework to prevent and combat child sexual abuse online. As negotiations on the proposed long-term regulation are ongoing, the Commission has proposed extending the interim regime until 3 April 2028.

In his opinion, the EDPS acknowledges that combating child sexual abuse constitutes an objective of general interest recognised by the European Union. At the same time, he reiterates concerns raised in earlier opinions regarding the legal basis for processing personal data under the Interim Regulation.

The EDPS recommends strengthening legal certainty, particularly in relation to compliance with the General Data Protection Regulation (GDPR). He also calls for clearer safeguards to prevent general and indiscriminate scanning of communications, emphasising the need to ensure that any interference with fundamental rights complies with the principles of necessity and proportionality.

The opinion will inform discussions among the European Parliament and the Council as they consider the proposed extension.
