The Internet Freedom Foundation (IFF) has submitted recommendations to Meta’s Oversight Board in a case involving AI-generated non-consensual sexualised content that remained available on Instagram despite user complaints.

The case concerns a video allegedly created using artificial intelligence to impersonate a woman without her consent. According to the complaint, the video showed the individual in a sexualised manner. Meta determined that the content did not violate its Adult Nudity and Sexual Activity (ANSA) Policy, as it did not depict a sexual act, and allowed the content to remain visible to adult users.

In its submission to the Oversight Board, IFF argued that Meta’s current policies do not adequately address non-consensual intimate imagery (NCII), including deepfake content created with AI tools. The organisation recommended expanding the platform’s policies so that sexualised images created or shared without consent are covered by moderation rules.

IFF also proposed introducing a specific reporting category for NCII, separate from general pornography reports. According to the organisation, this would allow victims to report harmful content more easily and receive faster review and removal decisions.

At the same time, the group emphasised that stronger protections against deepfake abuse should include safeguards for freedom of expression, ensuring that satire, journalism, and political speech are not mistakenly censored.

The Oversight Board opened the case for public comment in February 2026 and is expected to issue a decision that could influence how Meta moderates AI-generated sexualised content across its platforms.
