Commission and EUIPO sign agreement to support DSA enforcement on intellectual property

The European Commission has signed an agreement with the European Union Intellectual Property Office (EUIPO) to support enforcement of the Digital Services Act (DSA) in areas related to intellectual property rights.

The agreement takes effect immediately and aims to strengthen the Commission’s capacity to enforce EU rules governing online platforms. It focuses in particular on systemic risks linked to very large online platforms and search engines, including the spread of content that infringes intellectual property rights.

Such risks include the sale of counterfeit goods and the distribution of pirated content online. These activities fall within the scope of the DSA, which requires platforms to assess and mitigate risks associated with their services.

Under the agreement, the EUIPO will expand its role in supporting enforcement efforts. This includes providing assistance to judicial and enforcement authorities, as well as to online intermediaries that are not classified as very large platforms under the DSA framework. Intellectual property rights holders are also expected to be involved in addressing infringement risks.

The Digital Services Act establishes a set of rules aimed at improving safety and transparency in the EU’s digital environment. Cooperation between EU institutions and specialised bodies such as the EUIPO is part of how these rules are implemented in practice.

The agreement reflects a focus on addressing intellectual property issues within broader platform regulation, including responsibilities of online intermediaries and oversight of digital markets.
